General Terms and Conditions (GTC)

Registration & Booking

You can register in person, in writing, or online. By doing so, you acknowledge our GTC, the terms of participation, and the park rules for Abenteuerpark Achensee. Your registration becomes legally binding upon submission.

Terms of Payment

Unless otherwise agreed, payment for individuals or small groups is made on-site. For trainings, seminars, or corporate events, payment is handled via invoice following the event. All group programs are calculated based on the stated minimum number of participants. If fewer people attend, the minimum number will still be invoiced.

Cancellation Policy

  • Cancellations by the participant/visitor up to 10 days before the event or no-shows will result in a fee of 50% of the invoice amount.

  • If the number of participants is lower than originally stated, we must be notified by the day before the event; otherwise, the full number of registered participants must be paid for.

  • Deposits are non-refundable in the event of a cancellation but can be credited toward a future booking.

Liability

The use of the climbing park involves inherent risks and is at your own risk. Improper handling of equipment or safety techniques can lead to severe injury or death. Visitors must read and sign the participation agreement before entering.

Note for Arthur: In your original text, there is a reference to "Kletterpark Purkersdorf." You might want to update this to "Abenteuerpark Achensee" to ensure your legal documents are consistent with your location.

Safety Regulations

Participants must meet the necessary physical and mental requirements for their chosen activities.

  • Instructions: For the safety of everyone, instructions from our trainers must be followed immediately and at all times.

  • Sobriety: Persons under the influence of alcohol, drugs, or medication are not permitted to enter the park.

  • Physical Restrictions: Please inform your trainer of any physical limitations (illness, etc.). Climbing is strictly prohibited during pregnancy. It is also prohibited for individuals with spinal injuries or heart/circulatory conditions.

  • Induction: Every participant must attend the safety demonstration and complete the induction course before entering the park.

  • Binding Decisions: Trainers' decisions are final. Failure to comply with safety requirements may lead to expulsion from the park without a refund.

 

Equipment

Rental equipment (helmets, harnesses, safety lines, etc.) must be used exactly as instructed by the trainer. It is non-transferable, must not be removed while on the courses, and must be returned immediately after use.

Unused Services

If a visitor chooses not to use certain services (e.g., due to reaching a personal limit) or is unable to meet the physical requirements, the fee remains due and no refund will be provided.

Force Majeure

Our trainers have the right to cancel or interrupt activities for safety reasons (e.g., weather conditions). In such cases, the fee is non-refundable; however, we will gladly arrange an alternative date.

Use of Images

By paying the participation fee and agreeing to the terms, participants consent to the public distribution of photographs taken during their stay. Any exceptions must be requested in writing in advance. No personal data will be published in connection with these images.

Severability Clause

If any provision of these GTC is or becomes partially or fully invalid, the validity of the remaining provisions shall remain unaffected.

Jurisdiction & Governing Law

The exclusive place of jurisdiction for all disputes arising from this relationship is the District Court of Schwaz, Tyrol. Austrian law applies.
